These Terms of Service ("Terms") govern your access to and use of the Marrow website at marrowpet.com (the "Site") and the products and services offered by Marrow Pet, Inc. ("Marrow," "we," "us," or "our"). By using the Site, joining our waitlist, or purchasing our products, you agree to these Terms. If you do not agree, do not use the Site.
1. About Marrow
Marrow is a daily soft-chew supplement for senior dogs. Our products are dietary supplements intended to support the general health of dogs aged 7 and older. They are not intended to diagnose, treat, cure, or prevent any disease. The statements on our Site and product labels have not been evaluated by the U.S. Food and Drug Administration. Always consult a licensed veterinarian about your specific dog's health before starting any new supplement, particularly if your dog is on prescription medication or has existing health conditions.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from Marrow or join the waitlist. By using the Site you represent that you meet this requirement.
3. Waitlist
Joining the Marrow waitlist is free. By submitting your email, you consent to receive launch-related emails from us. You can unsubscribe at any time. Waitlist membership does not guarantee product availability or any specific pricing — promotional offers are subject to change or revocation in our reasonable discretion.
4. Orders and payments
- Pricing. Prices are displayed in U.S. dollars unless otherwise noted. We may change prices at any time, but changes will not apply to orders already accepted.
- Order acceptance. Your order is an offer to buy. We may accept or decline any order in our reasonable discretion, including for suspected fraud or stock unavailability.
- Payment. Payments are processed by our third-party payment processor (Stripe). By providing payment information, you authorize us to charge the amount due, plus applicable taxes and shipping.
- Errors. If a pricing or product description error is discovered after your order is placed, we will contact you and offer to correct or cancel the order.
5. Subscriptions
If you sign up for a Marrow subscription, the following terms apply:
- Recurring charges. Your payment method will be charged automatically on each scheduled delivery date until you cancel.
- Modifying or cancelling. You can pause, skip, change the frequency of, or cancel your subscription at any time through your account or by emailing hello@marrowpet.com. Changes must be made at least 24 hours before your next scheduled charge to apply to that order.
- Founding-member pricing. Founding members who joined the waitlist within the first 500 spots receive a 30% lifetime discount on subscription pricing. This discount applies as long as the subscription remains active and is not paused for more than 6 consecutive months.
- No refunds for unused months. Subscription payments already processed are non-refundable for billing cycles already completed, except as described under our Money-Back Guarantee below.
6. Shipping
We ship within the United States only at launch (additional countries to follow). Orders typically ship within 1–3 business days of order confirmation. Estimated delivery times are not guaranteed. Risk of loss and title pass to you upon delivery to the carrier. Lost or damaged packages should be reported to hello@marrowpet.com within 14 days of the expected delivery date.
7. 60-day money-back guarantee
If you are not satisfied with your first Marrow order for any reason, contact us within 60 days of delivery and we will refund the purchase price, no return shipping required. Keep the bottle. The guarantee applies only to a single first-time order per household and does not extend to subsequent subscription deliveries.
8. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Interfere with or disrupt the Site or attempt to gain unauthorized access to any part of it;
- Use any automated means (bots, scrapers, etc.) to access the Site or collect data, except for publicly indexed search-engine crawlers;
- Copy, modify, distribute, or create derivative works of our content, brand, or product imagery without our written permission;
- Misrepresent your identity or impersonate any person or entity;
- Resell Marrow products without prior written authorization.
9. Intellectual property
All content on the Site — including text, images, logos, product designs, and the Marrow brand name — is owned by or licensed to Marrow Pet, Inc. and protected by copyright, trademark, and other applicable laws. You may not use any of it without our prior written permission, except as expressly allowed by these Terms or applicable law.
10. Reviews and user content
If you submit reviews, photos, testimonials, or other content to us, you grant Marrow a worldwide, royalty-free, perpetual, sublicensable license to use, reproduce, modify, distribute, and display that content in any media for any commercial or promotional purpose. You represent that you own or have the rights to submit the content, that it is accurate, and that it does not infringe any third-party rights.
11. Disclaimers — not veterinary advice
Marrow products are dietary supplements, not medications. Information on the Site, including ingredient details, FAQs, and customer support communications, is for general educational purposes and is not a substitute for advice from a licensed veterinarian who has examined your dog. Always consult a veterinarian before starting any new supplement, especially if your dog is taking medication, is pregnant or nursing, or has an existing medical condition.
To the maximum extent permitted by law, the Site and products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the products will produce any specific result.
12. Limitation of liability
To the maximum extent permitted by law, Marrow Pet, Inc., its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or any loss of profits, revenue, data, or use, arising out of or in connection with the Site or products, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Site or products will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Marrow Pet, Inc. and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or products in violation of these Terms or any applicable law.
14. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to personal jurisdiction there.
If you are a consumer outside the United States, you may have additional rights under your local consumer protection laws, which are not waived by these Terms.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated by email or a prominent notice on the Site. Continued use of the Site after changes constitutes acceptance.
